Families applying for permanent residency or an adjustment of status in the United States could soon face additional scrutiny if they have received certain public benefits.
U.S. Citizenship and Immigration Services (USCIS) announced it will expand enforcement of the “public charge” rule, allowing immigration officials to consider an applicant’s use of programs such as Medicaid, the Supplemental Nutrition Assistance Program (SNAP), cash assistance, and some housing benefits when deciding whether to approve a green card application.
The policy marks a shift from the standards used in recent years, when public charge determinations were generally limited to applicants who relied primarily on cash assistance or long-term government-funded institutional care.Â
Under the updated rule, immigration officers will evaluate each applicant using a “totality of the circumstances” test, considering factors including age, health, income, education, employment history, and use of certain public benefits.
Federal officials say the policy is intended to ensure that immigrants seeking lawful permanent resident status are financially self-sufficient and unlikely to depend on taxpayer-funded assistance in the future.
Immigrant advocates, however, say the change may discourage families from seeking healthcare, food assistance, or housing support for which they are legally eligible. They warn that fear and confusion surrounding the rule could lead some families to forgo essential services, even when receiving those benefits may not automatically disqualify them from obtaining a green card.
USCIS emphasized that no single factor determines the outcome of a public charge review. Each green card application will continue to be evaluated individually, with officers weighing an applicant’s overall circumstances before making a decision.
Community organizations are encouraging residents with questions about the new policy to seek guidance from qualified immigration attorneys or accredited legal service providers before making decisions about public benefit programs.
