New York City Sues Trump Administration Over Revoked $80 Million Migrant Funds

New York City filed a federal lawsuit against the Trump administration on Friday, February 21st, accusing it of unlawfully reclaiming more than $80 million in migrant housing funds that had already been approved and distributed. The lawsuit, submitted in the U.S. District Court for the Southern District of New York, contends that the funds were allocated under a congressionally approved program and withdrawn without due process.

According to the city, the Federal Emergency Management Agency (FEMA) deposited the funds into a municipal account on February 4th, only to remove them on February 11th without prior notice. Federal agencies later cited unspecified โ€œconcernsโ€ in a letter sent on February 19th but did not identify any actual violations by the city.

Mayor Eric Adams defended the legal challenge, emphasizing the financial burden New York has faced in managing the influx of migrants. โ€œOur immigration system is broken, but the cost of managing an international humanitarian crisis should not overwhelmingly fall onto one city alone,โ€ Adams said. โ€œThe $80 million that FEMA approved, paid, and then rescinded โ€” after the city spent more than $7 billion in the last three years โ€” is the bare minimum our taxpayers deserve.โ€

The lawsuit names President Donald Trump, the U.S. Treasury, FEMA, and the Department of Homeland Security as defendants. It argues that the government violated federal grant regulations, overstepped its authority, and failed to follow legal procedures.

City Corporation Counsel Muriel Goode-Trufant, who is leading the legal effort, criticized the administrationโ€™s actions. โ€œThe Trump administration, without any notice or administrative process, and in violation of federal regulations, unilaterally withdrew more than $80 million,โ€ she said.

The dispute over the funds escalated after businessman Elon Musk claimed that the Department of Government Efficiency (DOGE) had uncovered fraud involving FEMA payments for migrant housing in luxury hotels. Trump echoed the allegations, asserting that the funds were being misused.

City Comptroller Brad Lander, a frequent critic of Adams and a candidate in the upcoming mayoral election, claimed credit for pushing the city to sue. โ€œAfter my office discovered that Elon Musk and his DOGE goon squad stole $80 million out of the Cityโ€™s coffers, we successfully pressured Mayor Adams to allow the Cityโ€™s lawyers to sue the federal government to get our money back,โ€ Lander said.

The lawsuit seeks a court order compelling the federal government to return the funds and block similar actions in the future. City officials report that the number of migrants in taxpayer-funded shelters has decreased from 69,000 last year to fewer than 45,000.
